01Parties & effective date
This Coaching Service Agreement (the “Agreement”) is between:
- The Coach — Julian Spiller, trading as Be The Change Fitness, a sole-trader fitness coach based in Wales, UK (“BTC,” “we,” “us”).
- The Client — the individual (or, in the case of couples coaching, the named individuals) who purchases a coaching package, whose name is recorded at sign-up and against the payment record (“you,” “your”).
The effective date is the date of purchase. By completing checkout for any paid coaching package, you confirm that you have read, understood, and agreed to this Agreement together with the Terms of Service, the Privacy Policy, and the Refund Policy.
02The Services
BTC provides personalised online 1-to-1 fitness coaching consisting of:
- An individualised training programme appropriate to your goal, history, available equipment, and time.
- Nutritional guidance and macronutrient targets where appropriate.
- A weekly check-in cycle (default cadence: Saturday submission, response by Monday).
- Ongoing communication via the Kahunas app, email, and where appropriate Instagram DM.
- Scheduled video calls (via Calendly + Zoom/Google Meet) where included in your package or by agreement.
- From mid-June 2026 onwards, optional in-person personal training sessions may be available to clients within travelling distance of the Wales studio location, subject to a separate session-by-session arrangement.
Tiers — what’s included

What’s not included
- Medical advice, diagnosis, or treatment.
- Physiotherapy or rehabilitation prescribed by a registered physiotherapist.
- Supplement prescriptions or recommendations of any specific brand or product as treatment.
- Psychological or psychiatric care of any kind.
- 24/7 on-call availability — communication is during normal UK working hours (see section 09).
03Your obligations as Client
- Honest intake. Provide accurate and complete information at onboarding — medical history, injuries, medications, past training, dietary restrictions, and any condition that could affect safety.
- Ongoing honesty. Tell the Coach promptly if your medical position changes, if you sustain an injury, become pregnant, start new medication, or receive a diagnosis that affects training.
- Programme follow-through. Make a reasonable effort to follow the prescribed programme and to log accurately. Coaching outcomes depend on your input.
- Weekly check-in. Submit your check-in by the agreed weekly cadence (default Saturday). Repeated missed check-ins reduce our ability to coach effectively.
- Honest measurement. Weigh, measure, and report progress photos honestly — we can’t adjust what we can’t see.
- Pay on time. Honour the payment schedule for your package — one-off, monthly Stripe recurring, or Klarna pay-in-3.
- Respectful communication. Communicate respectfully across all channels. Abusive, threatening, or harassing communication is grounds for termination without refund.
04Coach obligations
- Programming. Provide an individualised training and nutrition programme appropriate to your goal and circumstances within 5 working days of completed onboarding.
- Response times. Respond to weekly check-ins within 2 working days. Respond to in-app messages and emails within 2 working days Monday–Friday.
- Adaptation. Adjust the programme in response to your check-ins, progress, and life circumstances.
- Professional conduct. Act with reasonable care and skill consistent with the standards expected of a UK fitness coach.
- Honest counsel. Tell you when something is outside the Coach’s scope (e.g. a medical issue requiring a GP, a physio question requiring a physio) and refer you on appropriately.
05Health & safety
The Coach is not a medical doctor, physiotherapist, registered dietitian, psychologist, or any other regulated healthcare professional.
By signing this Agreement you confirm that:
- You are medically fit to train and to follow nutritional guidance, or you have obtained appropriate medical clearance before starting.
- You will inform the Coach promptly of any change to your medical position, any injury, any new medication, any pregnancy, or any condition relevant to safe training.
- You accept personal responsibility for your training, your nutrition, and the way you implement the programme — including making sensible adjustments when something feels wrong.
- You will stop training and seek medical advice if you experience pain, dizziness, shortness of breath, or any other warning sign — and you will inform the Coach.
The Coach reserves the right to pause or terminate coaching where it is unsafe to continue without medical clearance — for example where a Client refuses to take advice to see a GP about a symptom that creates real risk.
06Confidentiality (both ways)
Coach to Client: we treat your personal data, your photos, your weights, and the contents of our communication as confidential and use them only to deliver coaching, in line with the Privacy Policy. Identifying information is never shared publicly without your prior written consent.
Client to Coach: the BTC methodology, training and nutrition frameworks, recipe books, and client-facing materials are the intellectual property of Julian Spiller / Be The Change Fitness. You may use them for your own coaching journey but you may not republish them, share them with other coaches, or build derivative coaching products from them.
Where you choose to share testimonials, progress photos, or quotes, we will only use them publicly with your prior consent — in writing, by Kahunas message, or by email reply — and you can withdraw consent at any time for future use.
07Term & termination
Term
The Agreement runs for the length of your package — one month (Monthly recurring), three months, six months, or twelve months — from the effective date.
Cancellation by you
Cancellation is governed by the Refund Policy:
- Within the 14-day cooling-off period — full or pro-rata refund.
- Monthly recurring — cancel before next billing, no further charges.
- One-off package after 14 days — non-refundable in the ordinary course, but exceptional circumstances (medical / injury / life event) are reviewed case by case.
Pause for medical or exceptional reasons
You may request a pause of up to 12 weeks at no cost for genuine medical, injury, pregnancy, bereavement, or significant life-event reasons. Longer pauses are possible by agreement.
Termination by Coach
The Coach may terminate this Agreement on written notice for material breach (including non-payment, dishonest reporting, or abusive communication) or where continuing coaching would be unsafe. Where coaching is terminated for safety reasons unrelated to Client conduct, the Refund Policy applies and a fair pro-rata refund will be offered.
08Liability
The Coach is not liable for any injury, loss, or condition arising from:
- Training or nutrition decisions you take against the Coach’s advice or written guidance.
- Failure to disclose, at intake or during coaching, a medical condition, injury, or medication that would have changed the programming.
- Use of any third-party equipment, gym, supplement, or service not specifically prescribed by the Coach.
The Coach’s total aggregate liability in connection with this Agreement is capped at the amount you paid for the relevant coaching package in the preceding twelve months.
Nothing in this clause excludes or limits liability for death or personal injury caused by the Coach’s negligence, for fraud, or for any other liability that cannot be excluded under UK law — including under the Consumer Rights Act 2015.
09Communications & working hours
- Primary channels: Kahunas in-app messaging and email (contact@bethechangefitness.co.uk).
- Calls: by appointment via Calendly.
- Working hours: Monday to Friday, UK business hours. We do not guarantee response outside these hours. The Coach does not provide a 24/7 emergency service — for any genuine medical emergency, call 999 (UK) or your local emergency number.
10Intellectual property
All BTC methodology, training plans, nutrition frameworks, recipe books, written content, and visual brand assets remain the intellectual property of Julian Spiller t/a Be The Change Fitness. Coaching deliverables are provided to you for your personal use only. You may not republish, distribute, sell, or build derivative coaching offerings from them.
You retain ownership of your own data (your photos, measurements, written check-ins) and grant the Coach a non-exclusive licence to use them only for the purpose of delivering the Services in line with the Privacy Policy.
11Variation
Any variation of this Agreement — for example changing your package, changing your billing schedule, or extending your term — must be agreed in writing (email or Kahunas message is sufficient) between you and the Coach.
12Entire agreement
This Agreement, together with the Terms of Service, Privacy Policy, and Refund Policy, forms the entire agreement between you and BTC and supersedes any prior conversation, proposal, or representation.
13Governing law and jurisdiction
This Agreement is governed by the laws of England and Wales. Any dispute that cannot be resolved by good-faith discussion is subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause limits the consumer-law protections available to you in your country of residence if you are based in another part of the UK or in the European Economic Area.
14Acceptance
Because coaching packages are purchased online via Stripe or Klarna, this Agreement is accepted by the act of completing checkout for any paid coaching package. The Stripe checkout footer references the Terms of Service, Refund Policy, and this Coaching Service Agreement. Successful payment is conclusive evidence of your acceptance of all three documents, together with the Privacy Policy.
